BAF has prepared a primer on GST, covering the key aspects of the applicability of GST for apartment associations with simple illustrations.
Apartments are currently paying GST on maintenance charges beyond the threshold of Rs. 7500 per month. This is completely unreasonable as the association is neither providing a service nor making a profit out of maintenance charges. Hence, neither income tax nor GST should be chargeable, based on the principle of mutuality.
With inflation & increasing costs, more & more apartments are now coming under the ambit of GST.
BAF is taking this matter up with the Finance Ministry & GST Council to exempt maintenance charges from GST. It would be good if every apartment association can send a letter & email to the Finance Minister / GST Council.
Please find enclosed a format of the letter that BAF has created.

People living in apartments, no matter how large an apartment complex is, are NOT bulk-consumers. We are the same as individual house owners. All tariffs applicable to apartments should be on par with individual house owners. In addition, club house, swimming pool, STP etc. in apartment complexes are not commercial activities, hence all tariffs (water, power etc.) should only be at residential rates and not at commercial rates.

The same was exempt from service tax earlier but has not been exempt from GST and hence the appeal.
